In its final report, the Iacobucci Inquiry found what could hardly come as a surprise to many: Canadian officials played a role in the detention and torture of Canadians abroad. But few have noted what may be the most significant aspect of the inquiry. Conducted almost entirely in private, it marked the culmination of a trend toward greater secrecy in the public oversight of national security affairs after 9/11.

Author and lawyer Robert Diab explores the expansion of state secrecy and its impact on the accountability of the RCMP and other law enforcement agencies at a time when their role in counterterrorism and the powers they exercise, have become significantly greater. Situating the trend toward greater secrecy at the heart of Canada’s counter-terror strategy -- including the treatment of detainees, security certificates and those charged with new terrorism offences -- Diab argues these developments pose a serious threat to the rule of law in Canada.

Robert Diab is is a practicing lawyer with experience in criminal, administrative and constitutional law. He is also an instructor at Capilano University in North Vancouver and holds graduate degrees in Law and Interdisciplinary Studies.
